    To avoid a huge legal battle I would say that the will should be in agreement with the beneficiary. I would also say that the trust would legally trump the will on said property.

    What I have heard locally is that some realtors are telling people they should have a will to cover what is inside the house, and of course charging excessive amounts of money to write up the will.

    I think easy is a relative term, I suspect it is easy yet costly since you will have to go to the notary and the bank and go through the bureaucratic nightmare of changing the paper work with all the stamps that the government loves so much.

    Well it certainly will be interesting then!

    When you look closely over how that forum has been edited it really is unbelievable how there is no protocol what so ever in the editing. It really is a my way or the highway type of editing. I just recently started reading a book on editing to help me better write and edit the paper and the one thing that is stated over and over again that when you start to edit you should always keep in mind the readers that are consuming the media.

    The editor is there for them, the consumers of the media and really no one else. Are you serving their needs. So many have left that forum because of the heavy handed nature of the moderator that it would seem the answer is a resounding no to the that question. It is really only slightly better at the other forum.

    In the states that forum would have been dead ages ago but since we are in Mexico and it was really the first one in San Carlos it became the most popular, in spite of itself.

    I spoke with Kimberly from Consultants International who I recommend highly and here was her response

    yes The names are public. The public registry in Guaymas is to have all deeds to properties, and for a fee, you can find out who owns what. You can read the document. Sometimes the public registry will ask for what reason. As a realtor they never ask…..we solicite and they dig it up.

    If you all remember the constitution was written by a bunch of white men. It clearly didn’t include people of color until a little thing called the civil war and then of course the civil rights movement after that and it is clear America still has a long way to go. Especially when you listen to some of these assholes at Fox.

    It is clear to me that those buffoons are strict constitutionalists when it comes to the second amendment, which Steward has shown plenty of times on his program. The rest of it they make up as they go along. Steward is at his best when he debunks those shit heads over at Fox and god do they make his job so very easy. I seriously doubt that there is any one network on air that is so hypocritical as them.

    All men are clearly not created equal in the minds of many men, especially those who wrote the constitution and America has a very long way to go, and I would be happy to debate that with the best of them. 🙂

    I don’t blame George for the Rottweiler Fiasco and am certainly not obsessed with him nor do I believe he is guilty of everything under the son. Never have claimed that. I have claimed and continue to do so that he has a done a shitty job of moderating the Viva Forum and of course on that subject I am certainly not alone.

    I think there is virtually no doubt in my mind that the posts from the Rottweiler thread flamed the fires of intolerance in San Carlos and I actually would expect much more from a forum moderator.

    Now I suggest that if we all really want to spark some life into a Political Forum then we might want to post a thread dealing with politics. I might run a story next month on several residents who are getting dumped by their insurance companies because of Obama Care.

    In case you have not noticed this site is advertising free, no one has asked you to donate anything to be part of this forum.

    One time someone pretending to be George posted on this site as George. I did George a huge favor, I traced down, via the IP, the server and gave the info to George, he was less than appreciative of the information. I am not an advocate of Gadsby that is for sure.

    It is a shame that the forum has not lived up to your expectations, maybe people are actually enjoying the holidays, politics free.

    I really don’t understand what the point of this thread was to begin with. I set this forum up at the request of a buddy because George killed the one on Viva,

    I can assure you that there is no strategy for this forum, and of course anyone can sign up. If George really shut down the VSC forum because two or three people were bashing him then that simply proves the point that he never should have been in charge of any forum from the get go.

    The Rottweiler fiasco is a perfect example of how not to edit a forum. Once you read the threads on that first post it becomes clear that George has no viable criteria for when he locks down a thread or deletes posts. It really is his own opinion more than anything. What was especially telling about that thread was how he asked Richard to take a picture of the owner of the Rottwielers residence and post it and then later in the thread he tells him he should have kept his mouth shut and stop complaining. Why didn’t George grow a pair and go take a picture of the Rottwielers residence and post it himself. He leaves the poor guy whose dog gets mauled to do all the work for him and then bashes him later for it.

    It was pitiful really.

    I would like to thank George and Bart as well for if it were not for them I would have never created San Carlos TV. When they deleted the info that I spend months on creating about that scum bag Chad E. Willis that was the last straw for me.

    So I would like to thank both of the San Carlos Forums!!

    the most successful forums for an area are usually the first ones, Viva was the first forum, thus still has the most users, to bad they do such a shit job of editing it. It could have really been a much better asset to the community.

    The most patriotic thin a man or women can do is to question the powers that be, especially when that power is your own government.

    Ethnocentrism and Jingoism’s are often mistaken for patriotism.

    I highly suggest, if anyone has not already done so, reading the wonderful books written by the late great Chomers Johnson. Blow Back, Sorrows of Empire and the last one who’s name escapes me at the moment!!

    I will post the democracy now interview with Hersh that I just watched this morning that is a must see for anyone who wants to follow the story and then listen to Hersh talk about what the real story is that has not been written about yet. This is such a great story I might even put it in the paper since it just broke and our dead line is tomorrow.

    The story as told to Goodmin is not the fact that the administration didn’t tell the whole story. Who expects the whole truth from the government, I mean really? Listen to what Hersh says towards the end of the story if you want to hear what he, Hersh that is, believes is the real story.

    This is a story that was well covered in non main stream media out lets such as Democracy Now. Privatizing the prison system and making it a for profit business has lead to these types of abuses.

    It is disgusting. Also mandatory sentencing is another mistake left over from the Reagan years and the Absurd war on drugs, three strikes laws simply filled the prison with non violent drug offenders.

    What is undeniable is that America’s health costs have risen at an insane rate that has driven many Americans into bankruptcy. Health care is truly a human right and if America continues to want to claim it is the greatest nation in the world then the country must contain health costs and care for all. Obama care is also undeniably flawed but is the best that could be expected in the political gridlock that congress has become. Neither side is willing to compromise for the good of the country.

    Yes but remember what comes around goes around and the moment the democrats loose control they will start to whine like a bunch of stuck pigs, the senate is just a seat or two away from complete gridlock anyway at 50 each.

    What needs to happen in the U.S.A. is term limits and campaign finance reform. That is the only real game changer as far as I am concerned, the rest is minor stuff.

    Sorry it took so long to get back to you on this. So this is the dock over on the west side of the bay that Vicente Castro from El Bravo has been using then correct? Well who ever is using that dock must have a permit from Semarnap and I can tell you also that the company that has the concession for the whole bay just recently called me into their office to harass me over my mooring buoys. The entity that has the concession over that part of the bay is partly owned by the state and partly owned by the municipio of Guaymas. APIM is the name of the organization and their office is located just past Las Playitas but well before the Navy Boat Yard. You will see the large commercial docks off to the left and the gated entrance. Those are the guys that have the concession and I can almost guarantee that who ever is using that dock or who ever owned it did not have the proper permits. I guess the first thing you can do is start there. I would also after speaking with APIM go directly to the mayors office with a letter that is signed by all of the neighbors in the area and see if you can get some traction on it. Here is what I think. Guaymas is so broke right now they might see this as an opportunity to write some tickets and make some money off of this so that is the angle I would take with the Guaymas.

    Ok so Ines did speak with the secretary of the comisaria on this topic. You can indeed get a permit to have a load and obnoxious party. We were told by the secretary that you get the permit in Guaymas not here in San Carlos. I have actually been at parties when Ines was still managing the Althetic Club where the police showed up and tried to shut the party down if we didn’t have a permit.

    The secretary was not sure how late you could get the permit for but I suspect 2 a.m. sounds about right.

    So I believe that the definitive answer is yes your neighbor can get a permit to have a load obnoxious party until 2 a.m. After 2 he has to close it down.

    Next time any of you guys are driving down by Captains Club or Tequilas check out the building that used to be Surface Time Dive Shop. That building was sold out from under the owner by her ex husband. He signed the property over to their children and then before the paper work was registered sold the property to someone else. They are going like gang busters on it to finish it. Another said story of property fraud.

    The department of health here absolutely requires permits and does inspections of bakery’s and restaurants as well. I will look for the link online. I even suspect that you can report a business via online resources. Which is often the best way to report what we call a denuncio in Spanish. I just momementcs ago reported some illegal fishing events in San Carlos via internet.

    So do you report that illegal construction past their property line to control urbano then? What about reporting that to the CEA? All these cases are such a bummer, I was hoping things would be better in guaymas with Otto as the mayor but it seems like Bizness as usual here. Just got to stay vigilant I guess.

    well first off  peole can not just build on your property,  they would have to get a permit for constuction from guaymas to do any building and normally have to prove the property is in their name before they can get the permit. I don’t suspect there is any limits on time if the property is yours. If you want to email me a few more details in a private message please feel free to do so.

    There are cases out there in which people move into others peoples homes and properties and then construct on them and try to claim them so this is a very common practice and I have heard that after 5 years things become more difficult to take back but again if you have original title then that is everything. But of course now you have to fight to get your stuff back depending on what has been built on your property.

    Part two of our documentary south of the border land of disorder talks about this very subject when Catalina Ordaz built a house on a lot that did not belong to her. That litigation has been going on for many years now. hopefully someone did not build a house on your property.

    If it is just wires and electic cables then that is not to bad. I might go speak with the electic company or the phone company or who ever put up the wires before I yanked them down accidently in the dead of night and no one of course actually saw them get yanked down accidently as well.

    One of the main reasons I started this forum was so people could post information with out having to worry about it being taken down if they stepped on some ones toes. I truly believe that the Viva Forum has done tremendous damage to the community by not allowing anyone to post any information that might be construed as negative. Especially if the information was on the Ordaz family.

    If people have been wronged and ripped off then the only way to confront that is by publishing the information. The problem in Mexico is that white collar criminals almost never go to jail. What that means is that we need to let people know who is honest and who is not. Since the Ministerio Publico is so easily bribed here we need to warn people of who they can trust. If Viva or the San Carlos Mexico.com board had allowed people to post the truth I would have never started this web site.

     

    Alex told me flat out that he banned me from the Forum because he had been threatened by the Ordaz’s after our South of the Border Land of Disorder series came out. Alex told me that he was at home when someone knocked on his door. He opened it and was told by a someone claiming to be a lawyer for the Ordaz family that he would be sued if he allowed me to continue posting information on the forum. Alex never asked for any ID from this person nor their identification. That is how the Ordaz family works. They threaten the weak. It is sad since Alex I guess now lives in fear of the Ordaz Cartel. He shouldn’t. He should realize that the mouse is more mighty than the tongue of an Ordaz.

    Yes it does not surprise me that you would here something like that. It sounds like a typical VivaSanCarlos post. I can imagine several corrupt realtors would hate to see that go since improper registration of bank trusts have been long been used here in San Carlos to steal properties from unsuspecting owners.

    We will look into that tomorrow and give you an update, it might even be worth writing a column on it since it truly would be a revolutionary change for real estate development.
