Costa Del Mar HOA receives fine for non compliance with judges order

The Costa del Mar HOA has been ordered by a judge to hand over all of it’s book keeping starting from June of 2004 to the present. The dead line for delivering the requested material has now come and gone. A judge has now levied a fine against the HOA. The judge has also wants to see all of the meeting notes. Here is a quick and crappy google translation of the last paragraph of the document from the judge.

Administrative documents that consistent across each of the following accounting documents, prosecutors and the defendant used to conduct accounting, administrative and fiscal operations expenses including books, records associated, ordinary and extraordinary general meetings protocolised, minutes of general meetings duly protocolised where members approved the annual administrative operations, all document types where accounting activity, fiscal administrative operations of the association being sued. The fine for not providing the documents is mentioned in the document and is 20 times the minimum wage according to one document and then according to another the fine is 30 times the minimum wage. I am not sure exactly how the fine is levied but there is no doubt that the Costa del Mar HOA has not complied with turning over its accounting and has been fined. Now the question is why has the HOA refused to hand over its accounting? Do they have something to hide? I know I was told by members of the board of directors that files were lost during Jimena. If files were lost and then the loss not duly registered with the state of Sonora there could be big problems with that. There have also been controversial loans and payments to lawyers made by past presidents of the HOA. If these loans were not properly authorized by the HOA association there could be hell to pay for the HOA. It is all a civil matter at the moment but this does have the potential to turn into a criminal matter in the future.

    Thank you for insightful article on the HOA Costa del Mar board of directors.
    I wish the information you are providing at this time would have been available before, I would not have fallen into so many errors.
    Without doubt, the board, in particular, KEN, has been benefitting directly from the money of the other members. Ken has always been a member of the Costa del Mar board of directors and has never let go control of the checkbook of the HOA.
    Ken has a common practice of using privileged information, as former President and current Treasurer of the HOA, to force some owners to sell their properties at bargain prices.
    Ken purchased lots with Costa del Mar HOA money as well as he and his cronies loaned themselves HOA money to buy properties.
    It would seem that the reason that no one will ever see the books the judge is requesting, is because these fraudulent practices will be revealed. The fraud committed at Costa del Mar is much greater than you might imagine .
